Article 2<\/div>
Object and scope of application<\/div>

These General Terms and Conditions of Sale (hereinafter \u00abGTC\u00bb) govern all sales of online training courses offered by Breathwork Infinity to any natural person (hereinafter \u00abthe Student\u00bb or \u00abthe Client\u00bb) making a purchase through the online platform.<\/p>

Any order implies the unconditional acceptance of these GTC, which take precedence over any other document.<\/p>

Article L.111-1 and L.111-2 of the Consumer Code \u2014 obligation to provide pre-contractual information by the professional to the consumer.<\/div>

Article 3<\/div>
Description of the training and digital content<\/div>

The training offered by Breathwork Infinity is a digital content<\/strong> in the sense of Article L.111-1 of the Consumer Code, including:<\/p>

  • accessible educational videos online; ;<\/li>
  • downloadable documents (guides, course materials); ;<\/li>
  • practical exercises and\/or audio recordings; ;<\/li>
  • access to a secure member area.<\/li><\/ul>

    The provision of this digital content begins as soon as the Student accesses the member area for the first time or one of the training modules, which constitutes the starting point of the execution of the contract.<\/p>

    Pedagogical material is inseparable from the training; together with the digital content, they form a single contractual whole. The Student cannot rely on a refusal of any of the components to avoid paying the entire agreed price.<\/p>

    This material is provided for educational purposes as part of the exclusive training program. It remains the property of the Student upon completion of the training, subject to the full payment of all due fees.<\/p><\/div>

    The Student acknowledges and expressly accepts that, given the inseparable nature of the offer (digital training + material), and once access to the digital content has been activated concomitantly, the right of withdrawal on the entire offer is definitively excluded. Consequently, no partial or total refund will be granted once the material has been received or from the first access to the digital content.<\/p>

    Art. L.216-1 of the Consumer Code \u2014 performance of the contract; Art. 1186 of the Civil Code \u2014 lapse of an indivisible contractual package.<\/div>

    Article 4<\/div>
    Prices and payment terms<\/div>

    Prices are quoted in euros (\u20ac) and include all taxes (VAT). Breathwork Infinity reserves the right to change its prices at any time; the prices applicable at the time of ordering will apply.<\/p>

    Payment is due immediately upon ordering. It can be made by bank card or any other means offered at the time of ordering. In the case of payment plans (multiple installments), access to the training is conditional on the payment of the first installment.<\/p>

    In the event of subscribing to a multiple-payment facility, the Student acknowledges that the total price of the training constitutes a certain, liquid and payable obligation in the following cases:<\/p>

    • as soon as the educational material kit is received by the Student, regardless of the term in which it is being used or as soon as the first access to the online digital content is made; ;<\/li>
    • in the event of a default in payment of an instalment on its due date; ;<\/li>
    • in the event of termination of the contract at the initiative of the Student after access to the digital content has been granted.<\/li><\/ul>
      Consequences of non-payment<\/div>

      Any unpaid fees will result in the immediate suspension of access to the training, the recovery of the entire remaining amount due, and may result in recovery costs in accordance with the law. Late payment penalties at the statutory rate, increased, will be applied automatically.<\/p><\/div>

      Art. 1305-4 of the Civil Code \u2014 termination of the term in case of failure by the debtor; Art. L.441-10 of the Commercial Code \u2014 late payment penalties; Art. 1231-5 of the Civil Code \u2014 contractual penal clause.<\/div>
      Art. L.216-1 of the Consumer Code \u2014 obligation to deliver or perform on the agreed date.<\/div>

      Article 5<\/div>
      Right of withdrawal \u2014 Explicit exclusion for digital content<\/div>

      In principle, every consumer has a withdrawal period of 14 days<\/strong> from the conclusion of the contract for purchases made remotely.<\/p>

      Applicable legal exception<\/strong><\/p>

      In accordance with Article L.221-28, 13\u00b0 of the Consumer Code, the right of withdrawal does not apply to contracts for the supply of digital content not supplied on a tangible medium whose execution has begun with the express prior agreement of the consumer and the express waiver of their right of withdrawal.<\/p><\/div>

      By proceeding with payment, you expressly acknowledge: (1) requesting immediate access to the digital content of the training, and (2) irrevocably waiving your right of withdrawal once access to the training has been opened to your account.<\/p><\/div>

      Practical consequence:<\/strong> from the first access to the member space or to any module of the training \u2014 even partial \u2014 no reimbursement can be granted, whatever the reason invoked.<\/p>

      Art. L.221-28, 13\u00b0 of the Consumer Code (derived from European Directive 2011\/83\/EU, Art. 16 m) \u2014 exclusion of the right of withdrawal for digital content with immediate execution with consent and express renunciation<\/div>

      Article 6<\/div>
      Access and use conditions<\/div>

      Access to the training is strictly personal and non-transferable. The Student agrees not to share their login credentials, not to reproduce, disseminate or commercialize all or part of the educational content.<\/p>

      Any fraudulent use or unauthorized sharing of access will result in immediate termination of access without refund, and may be subject to prosecution for copyright infringement.<\/p>

      Article L.335-2 et suivants of the Code of Intellectual Property \u2014 protection of works of the mind and criminal sanctions in case of counterfeiting.<\/div>
      \u00a0<\/div><\/div>
      Article 7<\/div>
      Intellectual property<\/div>

      All the content broadcast as part of the training (videos, texts, sounds, images, exercises) is the exclusive property of Breathwork Infinity and is protected by copyright. Any reproduction or commercial exploitation is prohibited without prior written consent.<\/p>

      Article L.111-1 of the Code of Intellectual Property \u2014 moral and patrimonial rights of the author.<\/div>

      Article 8<\/div>
      Responsibility<\/div>

      Breathwork Infinity is committed to providing quality content and maintaining access to the platform under normal conditions of use. However, Breathwork Infinity cannot be held liable in the event of:<\/p>

      • Temporary interruption of access for maintenance; ;<\/li>
      • technical difficulties related to the Student\u2019s equipment or internet connection; ;<\/li>
      • the results obtained by the Student at the end of the training, as this is a requirement of means rather than a result.<\/li><\/ul>
        Article 1231-1 of the Civil Code \u2014 contractual liability and obligation to act in a reasonable manner.<\/div>

        Article 9<\/div>
        Personal data protection<\/div>

        The data collected during the ordering process are processed electronically for the management of the commercial relationship. In accordance with the General Data Protection Regulation (GDPR), the Student has the right to access, rectify and delete their data by contacting: contact@breathworkinfinity.com.<\/p>

        Article 10<\/div>
        Mediation and dispute resolution<\/div>

        In the event of a dispute, the Student is invited to contact Breathwork Infinity first via email in order to seek an amicable solution. In the event of failure, they can use the services of a competent consumer mediator free of charge.<\/p>

        Article L.612-1 et suivants of the Consumer Code \u2014 consumer\u2019s right to mediation; Directive 2013\/11\/EU on the out-of-court settlement of consumer disputes.<\/div>

        French law applies to these GTC. In the absence of an amicable resolution, any dispute shall be subject to the jurisdiction of the French courts.<\/p><\/div>
